HB 6264 Summary

• Requires each law enforcement agency in Michigan to appoint a "use of force inspector general" by January 1, 2021, to review and compile reports on use of force incidents and officer misconduct.

• Mandates inspectors classify use of force incidents by race of individuals involved (green for nonminority only, yellow for mixed, red for minority only), type of force used (hard hand, nonlethal, or lethal), and officer justification.

• Requires inspectors to determine whether force was reasonable or unreasonable and submit monthly compiled reports to the Michigan Department of State Police.

• Directs the Department of State Police to compile received reports and publish an annual statewide law enforcement use of force report on its website.

• Requires reports be retained for at least 50 years and subjects law enforcement agencies to criminal or civil sanctions, including loss of training and state/federal funding, for non-compliance.
