Permits notaries public to perform electronic notarizations using 2-way real-time audiovisual technology if identity is verified during the video conference, an audio/visual recording is made and retained, and the record is related to Michigan matters or property.

Allows notaries to select tamper-evident electronic notarization systems and requires notification to the Secretary of State before performing initial electronic notarizations; Secretary may disallow systems that don't meet established criteria.

Requires notaries performing remote electronic notarizations to maintain a journal recording date, time, nature of act, record description, individual names and addresses, identification method, and fees for at least 10 years.

Expands the definition of "in the presence of" to include interaction via approved remote electronic notarization platforms or 2-way real-time audiovisual technology, in addition to physical presence.

Effective immediately; provisions related to 2-way audiovisual technology apply from April 30, 2020 through December 31, 2020; encourages state agencies to use electronic records and signatures for notarized documents.
