HB 6428 Summary

• Amends the Drain Code of 1956 to transition public notice requirements from newspaper publication to the Local Government Public Notice Act, effective January 1, 2022.

• Requires drain commissioners and drainage boards to post notices online or through other methods specified in the Local Government Public Notice Act instead of publishing in newspapers before that date.

• Updates 28 sections of the Drain Code governing notices for drainage district hearings, board of determination meetings, apportionment reviews, drain abandonment proceedings, and other administrative actions.

• Maintains grandfather provisions allowing newspaper publication for notices issued before January 1, 2022, while requiring the new posting method for notices issued on or after that date.

• Takes effect 90 days after enactment and is conditioned on passage of either Senate Bill No. ____ or House Bill No. 6440 by the 100th Legislature.
