HB 6492 Summary

• Establishes the "COVID-19 Liability Protection Act" to limit civil and criminal liability for COVID-19 responders and health care facilities supporting Michigan's pandemic response.

• Defines "COVID-19 responders" as volunteers at health care facilities and licensed health care professionals, and "health care facilities" as hospitals, surgical centers, state-operated outpatient facilities, veterans facilities, and surge capacity sites.

• Shields COVID-19 responders and health care facilities from civil liability for injuries or deaths unless gross negligence is proven, and provides complete immunity from criminal prosecution for pandemic-related services.

• Does not eliminate or reduce other immunities or defenses available under Michigan law.

• Automatically repeals 120 days after enactment.
