HB 6547 Summary

• Allows persons convicted of not more than one felony and two misdemeanors (or two misdemeanors alone) to petition courts to set aside convictions after 5 or more years following sentence, probation completion, parole discharge, or imprisonment completion.

• Permits victims of human trafficking convicted under Michigan Penal Code sections 448-450 to petition for conviction expungement at any time, without the standard 5-year waiting period.

• Expands eligibility for expungement to include convictions under Michigan Vehicle Code section 602a (prior to amendment), allowing persons with such convictions to apply under standard expungement procedures in subsection (1).

• Maintains prohibitions on expunging certain serious offenses including life felonies, criminal sexual conduct charges, domestic violence felonies with prior domestic violence misdemeanors, and human trafficking violations occurring after January 12, 2015.

• Requires applicants to submit fingerprints and a $50 fee to the Department of State Police, notify prosecutors and crime victims of applications, and repeals MCL 257.602a effective 90 days after enactment.
