SB 281 Summary

• Amends section 16238 of the Public Health Code to clarify that information obtained in investigations or compliance conferences before a complaint is issued remains confidential and must not be disclosed except as necessary for proper functioning of hearings examiners, disciplinary subcommittees, or the department.

• Requires compliance conferences conducted before a complaint is issued to be closed to the public.

• Adds new section 16240 requiring the department to report licensees or registrants to law enforcement if the department determines reasonable basis exists that they violated sections 520b-520e of the Michigan Penal Code (relating to criminal sexual conduct) and has issued a formal complaint.

• Requires the department to notify identified victims that they may contact law enforcement and are afforded certain protections under the law, when victim contact information is available to the department.
