SB 761 Summary

• Exempts law enforcement officers from public and regional airport authorities from criminal conviction requirements for property forfeiture when the aggregate fair market value of seized property and currency exceeds $20,000, excluding contraband value.

• Modifies forfeiture procedures so that property seizures by airport authority officers are not subject to the requirement that a criminal conviction or guilty plea occur before civil forfeiture proceedings under MCL 333.7521a.

• Applies the $20,000 threshold exemption only to seizures by law enforcement officers appointed by public airport authorities under MCL 259.110 or regional airport authorities under MCL 259.139.

• Maintains standard forfeiture requirements for all other law enforcement agencies, which remain subject to the $50,000 threshold and criminal conviction requirements established in the amended statute.
