Summary of SB 782

• Establishes a licensing requirement for persons who sell tobacco products, vapor products, or alternative nicotine products at retail, effective October 1, 2020.

• Requires a separate license for each retail location, with a non-refundable fee not to exceed $100.00 per location and annual renewal costs not to exceed $75.00, administered by the Department of Treasury.

• Mandates display of a certificate of licensure at the point of sale and authorizes the Department to deny, suspend, revoke, or refuse renewal for false applications, fraudulent statements, or possession of fraudulent certificates.

• Raises the definition of "minor" from under 18 years of age to under 21 years of age for tobacco, vapor, and alternative nicotine product restrictions.

• Authorizes administrative fines up to $500.00 for violations and requires collected fees and fines to be used for administration and enforcement of the Act; includes clarifications that vapor products exclude marijuana-related products.
