SB 830 Summary

• Prohibits restraining pregnant or postpartum incarcerated individuals (within 12 weeks of childbirth) unless an individualized determination finds restraints necessary for safety, with explicit ranking administrator approval and treating medical provider consent.

• Bars use of leg irons, waist chains, abdominal-touching devices, and wrists-behind-back handcuffs on pregnant or postpartum individuals during transport; prohibits segregation or isolation of pregnant or postpartum individuals.

• Requires pregnancy testing for incoming female incarcerated individuals age 50 or younger, and mandates pregnant individuals be allowed to develop birth plans with obstetrician-gynecologists, certified nurse midwives, or doula service providers.

• Ensures incarcerated individuals who gave birth within 12 months and are breastfeeding have opportunities to breastfeed during visits and express milk with access to breast pumps and refrigerated storage.

• Requires department to provide quarterly reports to legislature and public with data on pregnant incarcerated individuals including numbers, race, age, high-risk pregnancies, medical appointments, and restraint documentation; effective 90 days after enactment.
