SB 833 Summary

• Changes references from "act" to "part" in multiple exemption sections of the Freedom of Information Act (replacing instances in sections 13(1)(a), (c), and (k)).

• Adds new exemption (bb) for records in the executive office of the governor or lieutenant governor relating to appointments, removals, pardons, budget recommendations, expenditure reductions, legislative messages, and the executive residence.

• Adds new exemptions (cc) through (gg) protecting executive privilege, pre-January 1, 2021 gubernatorial records, communications with constituents, security-related information, and cell phone numbers of the governor and lieutenant governor staff.

• Modifies language in subsection (2) regarding school directory information by changing "shall" to "is" and "shall be" to "will" in provisions about preventing misuse of disclosed directory information.

• Effective date is January 1, 2021, contingent upon Senate Bill No. 837 of the 100th Legislature also being enacted into law.
