SB 841 Summary

• Adds sections 29c and 29d to the Freedom of Information Act (1976 PA 442) to establish exemptions from public disclosure for legislative records created before January 1, 2021.

• Exempts from disclosure records created, prepared, owned, used, or retained by the majority or minority caucuses of each house of the legislature, and records of the office of sergeant at arms.

• Clarifies that the amendments do not create a private cause of action for violations and do not limit constitutional protections under section 11 of article IV of the Michigan Constitution.

• Establishes broad exemptions for personal information, medical/psychological records, legislative communications with constituents, attorney-client privileged materials, ongoing investigations, trade secrets, and records affecting law enforcement or public safety.

• Takes effect January 1, 2021, contingent on the enactment of Senate Bill No. 837 (tie-bar provision).
