SB 874 Summary

• Prohibits removal or exclusion of tenants and vendees from leased residential premises during the state of emergency declared under Executive Order No. 2020-4 and any extensions until June 1, 2020, unless they pose substantial risk to others or imminent/severe risk to property.

• Prohibits entering residential premises to remove/exclude tenants, vendees, or their personal property, including execution of writs of restitution or eviction orders, during the emergency period except in cases of substantial or imminent risk.

• Prohibits service of process requiring forfeiture of residential premises during the emergency period.

• Allows courts to adjourn proceedings, suspend, toll, or extend limitations periods, deadlines, and redemption periods under eviction law during the emergency.

• Establishes identical restrictions for mobile home park residents in Section 5782 and permits rent demands during the emergency only without threat of eviction or personal service; violations are misdemeanors punishable by up to 90 days imprisonment or $500 fine.
