SB 0884 Summary

• Amends the Adult Foster Care Facility Licensing Act to establish criminal history check requirements for individuals employed by or contracting with adult foster care facilities who have direct access to residents.

• Prohibits employment of individuals convicted of relevant federal crimes, felonies involving violence/abuse/sexual conduct/weapons, and specific misdemeanors within defined timeframes (ranging from 1 to 15+ years depending on offense severity).

• Requires adult foster care facilities to request criminal history checks through the Department of State Police, conduct registry checks, and obtain fingerprints; allows conditional employment pending completion of background checks under specified conditions.

• Establishes an automated fingerprint identification system database maintained by the Department of State Police to provide automatic notification when individuals with submitted fingerprints are subsequently arrested.

• Authorizes the Department of Health and Human Services to temporarily suspend fingerprinting requirements during states of emergency and disaster declared under Executive Order No. 2020-30 or extensions thereof.
