SB 908 Summary

• Establishes the State Technology Oversight Act and creates a State Technology Oversight Board within the Department of State Police to review and regulate state surveillance technology.

• Board consists of 9 members including the state police director, Michigan Intelligence Operations Center representative, two gubernatorial appointees representing Fourth Amendment rights, and four members appointed by the governor with senate consent (prosecutors, sheriffs, police chiefs, courts, and privacy advocates).

• Board shall establish guidelines for distribution, possession, and use of state surveillance technology and research recommendations on disease tracking technologies while protecting Fourth Amendment rights.

• State departments, agencies, and law enforcement agencies that do not follow board guidelines or lack established guidelines must submit annual reports detailing surveillance technology possessed, frequency of use, costs, policies, data storage protections, and whether the technology contributed to criminal charges or convictions.

• Board shall submit annual findings to the legislature by February 1 each year; act takes effect 90 days after enactment.
