SB 0938 Summary

• Allows on-premises liquor licensees that are also licensed as food service establishments to fill and sell beer, wine, mixed spirit drinks, or spirits in qualified containers (up to 1 gallon) for off-premises consumption.

• Permits on-premises licensees to deliver alcoholic beverages to consumers statewide, provided they verify the recipient is 21 years old or older and comply with all applicable state laws and taxes.

• Requires delivery packages to be labeled "Contains Alcohol. Must be delivered to a person 21 years of age or older" with no straw holes, and recipients must provide age-verified identification and sign upon delivery.

• Requires filled containers to be prepared at the time of sale (not in advance), comply with food service establishment standards, use commission-registered and approved alcoholic liquor, and follow all commission rules.

• Sunsets after 3 years from the effective date of the amendments.
