SB 948 Summary

• Adds Part 343 to the Natural Resources and Environmental Protection Act to address riparian contamination and structures along Great Lakes and connecting waterways (St. Marys River, Detroit River, St. Clair River, Lake St. Clair).

• Requires the Department of Natural Resources to conduct a comprehensive risk assessment by January 1, 2021, for all riparian properties currently or formerly used for industrial or commercial purposes.

• Risk assessments shall rate each property as high-, medium-, or low-risk based on factors including historic uses, hazardous substances, compliance history, inspection records, active monitoring status, water levels, and proximity to water supply intakes.

• Mandates creation of a public database containing all riparian properties and their risk assessment ratings to be posted on the department's website.

• Requires the department to update the risk assessment and database at least once every 5 years.
