SB 993 Summary

• County prosecuting attorneys must notify the Michigan Attorney General when allegations arise that a law enforcement officer committed a crime while performing their duties.

• Prosecuting attorneys must file a petition with the Attorney General requesting appointment of a special prosecuting attorney to handle cases involving officer misconduct.

• The Attorney General may either provide oversight authority in the investigation and initiate charges, or appoint a special prosecuting attorney who consents to the appointment to handle the matter.

• Prosecuting attorneys must notify the Attorney General of allegations that law enforcement officers used excessive force or violated civil rights during their duties.

• The Attorney General may provide oversight of excessive force or civil rights violation investigations or designate another agency to investigate such allegations.
