SB 1064 Summary

• Amends MCL 777.16m of the Code of Criminal Procedure to update sentencing guidelines for firearm-related felonies in Michigan.

• Adds two new offenses to the sentencing guidelines table: MCL 750.223(5) for straw purchases of firearms (Class C felony, 15-year maximum) and MCL 750.223a for sales of firearms used to commit felonies (Variable class and penalty).

• Updates sentencing classification and maximum penalties for various existing firearm offenses including possession by felons, unlawful firearm sales, and improper use of weapons.

• Takes effect only if Senate Bill No. 1065 of the 100th Legislature is enacted into law (tie-bar provision).
