• Requires insurers to provide agents of record for large employer groups (100+ full-time employees) with detailed claims utilization and cost information upon request, subject to a signed nondisclosure agreement.

• Mandates insurers compile and provide in electronic, spreadsheet-compatible format comprehensive data including incurred/paid claims by category, prescription drug claims broken down by type (brand, generic, specialty), high-cost individual claims exceeding $25,000 annually, and administrative fees and commissions.

• Limits requests to once per calendar year per agent of record, with insurers required to provide information within 30 days covering the 24-month period ending no more than 60 days before compilation.

• Requires agents of record to disclose received claims information to any carrier or administrator soliciting bids to provide benefits or services for the medical benefit plan within 30 days of request.

• Restricts disclosed information to health data permitted under HIPAA; grants insurers immunity from civil liability for providing information in compliance with the law or subsequent use by others.
