Hospitals with fewer than 100 licensed beds may obtain a certificate of need for an extended care services program using up to 10 swing beds under Medicare requirements without paying a processing fee.

Extended care services programs must comply with Medicare regulations, including restrictions on patient charges, admission requirements, and limitations of 1,825 patient days per state fiscal year.

Hospitals must establish discharge plans within 3 days of admission and provide patients with specific rights including visitation privileges, access to personal possessions, participation in medical treatment decisions, and access to patient advocates.

Beginning January 1, 2021, hospitals operating extended care services programs must submit annual reports to the department detailing patient admissions, patient days, discharge destinations, and other program evaluation information.

Hospitals are prohibited from discharging, harassing, retaliating against, or discriminating against patients for exercising their rights under the extended care services program.
