SB 1166 Summary

• Creates the "Reporting of Law Enforcement Officer Misconduct Privacy Act" to protect the identity of individuals who file complaints against law enforcement officers.

• Prohibits any person from knowingly disclosing misconduct complaints or identifying information about the complainant in complaints involving excessive force resulting in death or serious bodily harm, or unauthorized, unlawful, abusive, negligent, reckless, or injurious conduct by law enforcement officers.

• Allows disclosure of complainant identity only in three circumstances: by the complainant themselves, with written permission from the complainant, or pursuant to a court order.

• Applies to law enforcement agencies, the department of state police, the department of the attorney general, attorneys receiving misconduct complaints, and any other bodies authorized to receive such complaints.

• Establishes a civil infraction penalty of up to $500 for violations of the act.
