SB 1187 Summary

• Extends the validity of notary public commissions that expired between March 1, 2020 and June 30, 2021 through June 30, 2021.

• Permits notaries to perform notarizations electronically using 2-way real-time audiovisual technology if specific requirements are met, including audio-visual recording, identity verification during the video conference, and same-day transmission of signed documents.

• Allows records to be signed in counterparts from April 30, 2020 through June 30, 2021 unless expressly prohibited.

• Establishes legislative intent that state agencies use electronic records, electronic signatures, and remote notarization using 2-way audiovisual technology to satisfy in-person witness and presence requirements from April 30, 2020 through June 30, 2021.

• Effective December 29, 2020, contingent on enactment of Senate Bills 1186, 1188, and 1189.
