SB 1208 Summary

• Requires manufacturers, producers, and distributors of consumer products or packaging containing PFAS (per- and polyfluoroalkyl substances) to provide warning labels or written notices to retailers beginning January 1, 2023.

• Retail sellers must display PFAS warnings on products under their own brand, products where they introduced PFAS, or products for which they received manufacturer notices, with conspicuous signage required when notices include signs.

• Warning labels must state that the product or packaging includes PFAS and that exposure to PFAS may have adverse health effects, with additional requirements set by the Department of Licensing and Regulatory Affairs.

• Violations subject to civil fines of $1,000 per day for the first year after enactment, escalating to $5,000 per day in year two and $10,000 per day thereafter; enforcement by county prosecutors or the Attorney General.

• Exempts entities with fewer than 10 employees, government agencies, and public water supply operators from the requirement to provide warnings.
