SB 1255 Summary

• Adds new subsection (15) effective January 1, 2021, requiring Michigan businesses to have a 7-day opportunity to match or beat the lowest bid from non-Michigan bidders on state contracts.

• Defines "Michigan business" as a business that meets both the existing definition in section 268 AND has its principal place of business in Michigan, pays majority employee payroll to Michigan residents, has majority employees who are Michigan residents, and manufactures goods entirely in Michigan (if applicable).

• Allows the department to award contracts to matching Michigan bidders; if multiple Michigan businesses match the low bid, the contract goes to the Michigan business with the lowest responsive and responsible best value bid.

• Requires the department to make all discretionary determinations and issue directives to implement the matching bid preference for Michigan businesses.

• Renumbers the existing definitions subsection from (15) to (16) to accommodate the new Michigan business preference requirement.
