HB 4057 Summary

• Expands definition of "restraint" to include chemical restraint and physically holding residents for forced medication, medical treatment, or laboratory study, and adds definition of "chemical restraint" as drugs used for discipline or convenience not required to treat diagnosed medical symptoms.

• Permits authorized licensed practitioners (physician assistants and nurse practitioners) to order restraint or seclusion in addition to physicians, with treating physician consultation requirements for patients under 21 years old.

• Establishes time limits for restraint or seclusion orders: 4 hours for adults 18+, 2 hours for ages 9-17, and 1 hour for children under 9, with maximum 24-hour total; requires personal examination within 1 hour and reassessment after 24 hours before new orders.

• Prohibits prone immobilization except when medically contraindicated and documented, requires less restrictive therapeutic interventions be attempted first, mandates debriefing after each incident, and prohibits use as means of coercion, discipline, or retaliation.

• Repeals MCL 330.1742 and takes effect 90 days after enactment.
