HB 4091 Summary

• Expands eligibility for conviction set-aside petitions to include any crime (not just prostitution-related offenses) if the person committed the offense as a direct result of being a victim of human trafficking.

• Allows a person convicted of up to 3 felony offenses total in Michigan to apply to have all convictions set aside, with limitations of no more than 2 assaultive crime convictions and no more than 1 felony conviction for the same offense if punishable by more than 10 years imprisonment.

• Treats convictions that were deferred and dismissed under specified statutes (liquor control, revised judicature act, criminal procedure code, public health code, and penal code provisions) as misdemeanor convictions for set-aside eligibility purposes.

• Takes effect April 11, 2021.
