HB 4100 Summary

• Amends the Code of Criminal Procedure (MCL 777.16w) to update sentencing guidelines for prostitution and human trafficking crimes.

• Replaces terminology "prostitution" with "commercial sexual activity" throughout the sentencing guidelines table for crimes under MCL 750.451, 750.452, 750.455-750.459, and 750.462f.

• Restructures penalty categories for commercial sexual activity violations: first offense classified as Class G felony with maximum sentence of 1 year; second offense as Class G with 2 years; third or subsequent offense as Class F with 4 years.

• Updates guidelines for human trafficking crimes including enhanced penalties for violations involving minors, bodily injury, or serious bodily injury, with maximum sentences ranging from 10 years to life imprisonment.

• Effective 90 days after enactment and contingent upon passage of HB 4112, HB 4113, and one additional bill (request no. 01595'21).
