HB 4113 Summary

• Replaces terminology "prostitution" and "concubinage" with "commercial sexual activity" and "child sexually abusive activity" throughout the Michigan Penal Code sections 13, 159g, and 411j.

• Amends section 13 to increase penalties for taking minors under 16 years old for commercial sexual activity or child sexually abusive activity (previously listed as prostitution or concubinage) to felony punishable by up to 10 years imprisonment.

• Updates section 159g's racketeering definition to reference "commercial sexual activity" instead of "prostitution" in violations of sections 452, 455, 457, 458, and 459.

• Modifies section 411j's definitions related to money laundering to include "cryptocurrency" as a monetary instrument and update references from "prostitution" to "commercial sexual activity."

• Takes effect 90 days after enactment and is contingent on passage of HB 4112.
