Establishes a future higher legal blood alcohol limit of 0.10 grams per 100 milliliters of blood (instead of 0.08) for operating while intoxicated, effective 5 years after the state treasurer certifies Michigan no longer receives federal highway construction funding conditioned on a 0.08 limit.

Removes the sunset provision that would have terminated the 0.08 blood alcohol limit, making it a permanent standard until the transition to 0.10 occurs.

Applies the new 0.10 limit to all operating while intoxicated violations under sections 625, 625a, 625g, and 625m, including enhanced penalties for serious impairment and death cases.

Requires the state treasurer to publish a certification on the Department of Treasury's website within 30 days of when federal funding conditions change, which triggers the 5-year countdown to implementation of the 0.10 limit.

Takes effect 90 days after enactment (November 21, 2021) but is contingent on House Bills 4220 and 4309 also being enacted into law.
