Amends sentencing guidelines sections 33 and 48 of Michigan's criminal procedure law to modify blood alcohol content thresholds for operating vehicles under the influence.

Changes the alcohol content threshold from 0.08 grams per 100 milliliters of blood (or equivalent breath/urine measures) to 0.10 grams, effective 5 years after the state treasurer certifies implementation under Michigan Vehicle Code section 625(28).

Applies the new 0.10 grams threshold to offense variable 3 (physical injury to victims) and offense variable 18 (operator ability affected by alcohol or drugs) scoring in sentencing calculations.

Takes effect 90 days after enactment, contingent on House Bill 4308 of the 101st Legislature also being enacted into law.

Approved by the Governor on August 23, 2021, with an effective date of November 21, 2021.
