Allows HIV-positive organs to be transplanted into HIV-positive recipients if the recipient has tested positive for HIV, is informed of the positive organ test result, and provides written consent along with the transplant physician.

Requires parental, guardian, or loco parentis consent for HIV-positive organ transplants into minors who are HIV-positive, with the same informed consent and written agreement requirements.

Maintains existing requirements that blood, tissue, organs, and other human specimens with positive HIV test results cannot be used for transplantation or transfusion except in emergency circumstances with informed written consent.

Preserves the requirement that all potential donors and specimens be tested for HIV or HIV antibodies before transplantation, transfusion, or introduction into a human body, except in emergencies.

Takes effect 90 days after enactment into law; enacted December 16, 2021.
