Establishes criminal penalties for distributors who, with intent to defraud or cheat, violate section 4c regarding nonalcoholic beverage containers purchased in another state.

Creates a tiered penalty structure based on the value of filled beverage containers: misdemeanor for less than $200 (up to 93 days imprisonment or $500 fine); misdemeanor for $200-$10,000 (up to 1 year imprisonment or $2,000 fine); and felonies ranging up to 20 years imprisonment with fines up to $35,000 for $100,000+ in container value.

Allows aggregation of beverage container values from separate incidents within a 12-month period when determining total violation amount.

Enhances penalties based on prior convictions, with enhanced sentences prohibited from further enhancement under MCL 769.10, 769.11, and 769.12.

Takes effect 90 days after enactment (effective March 27, 2022) and is conditioned on House Bill 4782 being enacted into law.
