HB 4884 Summary

• Allows removal of school board and intermediate school board members by the governor for gross neglect of duty, corrupt conduct in office, or misfeasance or malfeasance in office.

• Requires charges to be submitted in writing by a school or intermediate school district elector (resident voter) with supporting evidence and an affidavit verifying the charges.

• Governor must serve charges on the accused board member within 10 business days and allow a minimum of 10 business days for the member to respond.

• Governor must review charges and notify both the charging party and accused member of the determination within 60 calendar days; if no determination is made within 60 days, charges are dismissed but may be refiled.

• Person removed from office is ineligible for election or appointment to any school board or intermediate school board for 3 years from the removal date.
