Governor must announce within 30 days of a vacancy in a state senator or representative position whether to hold a special election or fill the vacancy at the next general election.

If vacancy occurs after the primary election but before the following general election, the governor may direct that the vacancy be filled at that general election.

Political party county committee executive committees may select a candidate by majority vote and certify the name to the county board of election commissioners within 21 days of the vacancy and at least 10 days before the general election.

If ballots have already been printed before candidate certification, the board of election commissioners must print the certified candidates' names on a separate ballot to be counted and canvassed with other ballots.

Secretary of state must provide notice of the governor's decision regarding whether the vacancy will be filled at a special election or the next general election.
