Expands the definition of "child care staff member" to include individuals aged 16 or older who are employed by, provide unsupervised care for, have unsupervised access to children in, or serve as licensee designee or program director at child care facilities.

Requires criminal history checks through state police and FBI for persons, licensee designees, chief administrators, and program directors applying for child care organization licenses, with exemption for those continuously licensed after a previous check.

Establishes automatic increased capacity eligibility for family and group child care homes after 29 consecutive months of operation with a regular license renewal, allowing 1 additional child for family homes and 2 additional children for group homes.

Allows department to rescind increased capacity due to corrective action, licensing action, or determination that increased capacity is not conducive to child welfare, with opportunity for appeal under section 11(2).

Maintains licensing fee structure ranging from $25 to $300 for original applications and $25 to $150 for renewals depending on facility type and capacity, with collected fees dedicated to the licensing program.
