Allow nurse aide competency examinations to be completed online, through remote means, or at nursing care facilities that proctor the exam under federal regulations (42 CFR 483.154).

Permit nursing care facility staff to contract with testing vendors to proctor nurse aide competency examinations.

Prohibit the department from denying permits to nurse aide training programs solely because they allow online or remote curriculum completion or count work experience performing nurse aide skills as training time.

Exclude online options from applying to hands-on training required under 42 CFR 483.152(a)(3) or practical testing required under 42 CFR 483.154(b)(2).

Take effect immediately upon enactment on May 19, 2022.
