Amends section 4 of the Michigan Consumer Protection Act to add a new subsection (4) that excludes persons regulated by article 9 of the occupational code (MCL 339.901 to 339.920) from existing exemptions in subsections (1), (2), and (3).

Modifies the exemption language in subsections (1), (2), and (3) to include the phrase "Except as provided in subsection (4)" to make the new exclusion applicable to those subsections.

Changes a statutory reference in subsection (2)(c) from MCL 475.1 to 479.43 to MCL 475.1 to 479.42 regarding the Motor Carrier Act.

Renumbers the final subsection from (4) to (5), which states that the burden of proving an exemption from the act is upon the person claiming the exemption.

Takes effect only if Senate Bill No. ____ or House Bill No. 5256 is enacted into law (tie-bar provision).
