MI HB5542

Establishes fundamental rights to choose or refuse contraception and sterilization, and to carry pregnancy to term, give birth, or obtain an abortion before fetal viability or at any time if necessary to protect the pregnant individual's life or health

Allows health care professionals to perform abortions before fetal viability, and after viability only if necessary to protect the pregnant individual's life or health

Prohibits the state from prosecuting or punishing a pregnant individual for acts or failures to act during pregnancy if the prosecution is based on potential, actual, or perceived impact on pregnancy or the individual's health

Permits civil lawsuits for violations of the act with courts awarding reasonable costs and attorney fees to prevailing plaintiffs

Repeals existing Michigan abortion restrictions including sections of the Michigan penal code, the Legal Birth Definition Act, parental rights restoration requirements, and the Abortion Insurance Opt-Out Act; takes effect 90 days after enactment and is contingent on passage of five related bills (HB 5543-5548)
