Amends MCL 257.628 to change the population threshold for charter counties from 2,000,000 to 1,500,000 when determining county road commission authority and defines "design speed" by reference to the seventh edition (2018) of the American Association of State Highway and Transportation Officials design standards.

Modifies MCL 257.627 and 257.628 to clarify that speed limit violations under these sections are civil infractions except as provided in section 638.

Adds new MCL 257.638(2) and (3) allowing drivers to exceed the applicable speed limit by up to 10 miles per hour while overtaking and passing another vehicle on the same road, limited to 10 seconds after safely passing, but prohibits this exception within city or village limits and school zones.

Makes technical corrections to MCL 257.628 by replacing "shall" with "must" throughout the section and changing "person" to "individual" for consistency.

Takes effect 90 days after enactment into law.
