Firearm owners are protected from liability for property damage or injuries resulting from use of their firearm by an unauthorized user if proper storage requirements are met.

For unloaded (nonactive) firearms, protection applies if the firearm is locked or rendered inoperable AND ammunition is stored separately AND all keys/combinations are restricted to owner and authorized users.

For loaded (active) firearms, protection applies if stored in a locked container within close proximity for ready retrieval by owner/authorized users OR in a locked container/safe designed for expedited retrieval.

Defendants claiming this liability protection must prove they satisfied storage requirements by a preponderance of the evidence as an affirmative defense.

Definitions establish "firearm" per 1927 PA 372, "active firearm" as loaded, and "nonactive firearm" as unloaded.
