School districts, intermediate school districts, and public school academies must develop or adopt a policy by July 1, 2023 addressing how pupils with prescriptions for medically necessary treatment from private health care specialists receive that treatment in school settings, in compliance with Section 504 of the Rehabilitation Act and the Americans with Disabilities Act.

Policies must require parents or legal guardians receive notice that federal law provides rights and protections for pupils to access medically necessary treatment needed for meaningful access to public education.

Policies must address the process for private health care specialists to observe pupils in school settings, collaborate with instructional personnel, and provide medically necessary treatment in school settings.

Policies must be made publicly available on school websites and inform parents of their right to appeal decisions concerning access to medically necessary treatment in school settings.

Schools must report annually to the Department of Education by July 1 (beginning July 1, 2024) the total number of requests for pupil access by private health care specialists and whether requests were authorized or denied; the Department must publish this information on its website and report to the legislature by January 1 each year.
