Hotel owners, managers, or agents must provide guests with a written schedule of smoking fees before renting or leasing any room.

Hotels must verbally instruct guests to review and sign the written smoking fee schedule upon check-in.

A copy of the written smoking fee schedule must be placed in a conspicuous area within every guest room and posted at a conspicuous location in the hotel.

Upon guest request before checkout, hotel staff must inspect the room in the presence of the guest and provide written notice stating whether smoking fees will be assessed.

Written inspection notices must be signed and dated by hotel staff, and must include the statement "Room has been cleared and no smoking charges will be assessed" if no fees apply.
