SB 189 Summary

• Adds preference in state construction contract awards to geographically disadvantaged business enterprises on equal terms with other evaluation criteria, in addition to existing 10% preference for qualified disabled veterans.

• Defines "geographically disadvantaged business enterprise" as businesses certified as HUBZone small businesses, located in qualified opportunity zones, or with majority employees in qualified opportunity zones.

• Establishes 5% annual procurement goal for geographically disadvantaged business enterprises across all state agency construction, goods, and services spending, with annual reporting to legislature.

• Requires department to review progress toward the 5% goal annually with input from disadvantaged business enterprises and business community, and make recommendations regarding continuation or adjustment of percentage goals.

• Directs governor to recommend legislative changes to assist geographically disadvantaged business enterprises in achieving procurement goals.
