Prohibits sale or distribution of tobacco products through U.S. mail, express mail, parcel post, or common carrier services except to persons who have previously paid or agreed to pay for products at fair market value.

Allows mail/carrier distribution of tobacco products only in response to consumer complaints or direct mail marketing to specifically named individuals who have previously returned a signed authorization card verifying they are at least 21 years of age, with the card kept on file for at least 1 year.

Requires direct distribution of tobacco products (without prior payment) to meet all conditions: distributor must only sell products it regularly manufactures, recipient must be verified as 21 or older, recipient must be physically present, and distribution must not violate local ordinances.

Establishes penalties for violation: misdemeanor with up to 1 year imprisonment and/or $10,000 fine for mail/carrier violations; misdemeanor with up to 90 days imprisonment and/or $500 fine, or 180 days community service for direct distribution violations.

Effective July 21, 2022, contingent on enactment of Senate Bill 577, Senate Bill 720, House Bill 6108, and House Bill 6109.
