Creates a jail diversion fund within the state treasury to receive money from any source, with earnings and fund balance remaining in the fund and not lapsing to the general fund.

Establishes a behavioral health jail diversion grant program using half of appropriated jail diversion funds to provide competitive grants to local units of government for programs that redirect individuals with behavioral health disorders away from the criminal justice system pre-arrest or post-arrest.

Prioritizes grants to counties without urbanized areas of at least 50,000 people and programs adhering to best practices identified by the mental health diversion council.

Requires grant recipients to submit memoranda of understanding between community and law enforcement agencies and to participate in annual evaluation reporting on program activities, metrics, and results.

Requires the department to submit annual reports by September 30, 2023 and thereafter to legislative appropriations subcommittees detailing grant recipients, amounts, subgrant disbursements, activities, and performance metrics.
