Senate Bill 961 Summary

• Amends MCL 600.2946 to change "shall be" to "is" in describing admissibility of evidence regarding production standards in product liability actions.

• Eliminates subsection (5) which provided that manufacturers or sellers of FDA-approved drugs are not liable for defects if the drug complied with FDA approval at the time of sale.

• Removes the exception that previously prevented liability protections from applying to drugs removed from the market or whose FDA approval was withdrawn.

• Removes provisions that limited drug manufacturer liability only when manufacturers intentionally withheld information from the FDA or made illegal payments to FDA officials.
