Removes the provision that prevents annulment of a marriage when parties freely cohabited as husband and wife after reaching the age of consent.

Allows annulment actions based on one party being under the legal age of consent to proceed without the requirement that parties had not cohabited after reaching legal age.

Maintains that only parents, guardians entitled to custody, or next friends of the minor may bring annulment actions on this ground.

Maintains that a party who was of legal consent age at the time of marriage cannot apply for annulment on this basis.
