Changes mandatory language ("shall") to permissive or required language ("may" or "must") throughout the guardianship assistance statute for clarity and consistency.

Department must determine guardianship assistance eligibility without regard to the prospective guardian's income.

Expands guardianship assistance agreement requirements to include that payment amounts reflect the standard age-appropriate foster care rate increases determined by the department.

Extends guardianship assistance provisions to include tribal child welfare agencies and tribal law or code for establishing legal guardianships when the child is a ward of the state.

Requires the department to make eligibility determinations within 30 days of receiving a complete application for guardianship assistance.

Effective only if Senate Bill No. 1206 of the 101st Legislature is enacted into law.
