Amends section 7455 of the Public Health Code to distinguish penalty levels for violations of section 7453 based on who commits the violation and what is sold.

Establishes that a person 18 years or older who sells or offers to sell an object specifically designed for inhaling nitrous oxide for recreational purposes or drug paraphernalia to a person under 18 is guilty of a misdemeanor punishable by up to 1 year imprisonment, a fine of up to $7,500, or both.

Maintains existing misdemeanor penalties (up to 90 days imprisonment or $5,000 fine) for other violations of section 7453 that do not involve selling nitrous oxide devices or paraphernalia to minors.

Takes effect 90 days after enactment only if Senate Bill No. ____ or House Bill No. 4348 of the 102nd Legislature is also enacted into law.
