HB 4387 Summary

• Amends Michigan's sentencing guidelines (MCL 777.16g) to add two new felonies to the sentencing framework table.

• Adds MCL 750.145h(3) - causing a vulnerable adult to provide sexually explicit visual material (second or subsequent offense) as a Class G felony with maximum 2-year sentence.

• Adds MCL 750.147c(2) and (3) - institutional desecration offenses involving damage valued at $20,000 or more (Class D, 10-year max) or $1,000-$20,000 (Class E, 5-year max) with prior convictions.

• Requires offenders using internet or computers to commit crimes to have their sentencing determined based on the underlying offense category and variables.

• Effective March 7, 2024, but only if House Bills 4320 and 4476 from the 2023 Legislature are also enacted (tie-bar provision).
